By using our services either via the web site
or by speaking to the doctor over the phone or you are deemed to consent to the terms
and conditions of the following disclaimer, and
any information and advice given by your e-med
doctor.
If you do not agree to these terms and conditions
please do not become a member and make use of
our services. e-med reserves the right
to change these terms and conditions at any time
by posting changes online. You are responsible
for regularly reviewing information that we post
online to get notice of such changes and amendments.
Any continued use of our site and services will
constitute acceptance of these changes. If you
have already joined as a member, and do not agree
with any of such changes then, on contacting
e-med you will be reimbursed your membership
fee in direct proportion to the time you have
spent as a member.
e-med provides medical advice, diagnosis,
referrals, prescriptions, and arrangement of
investigations online, by phone, and by Skype for UK and EU citizens, as well as any country where it is within their laws do do so. This does not include the USA.
e-med consultations and memberships are for adults, aged 18 years and above only. e-med will not consult with or offer advice for minors under the age of 18 years of age.
A membership fee of £20.00 is payable annually
and will be automatically debited from your credit card details
which we will hold.
Each consultation ,episode
of advice, referral, or arrangement of prescription
and investigation is priced at £15.00 if
by e-mail or phone, and £40.00 if face
to face and payable at or after completion of
the episode by direct debit from your card.
Any additional costs for investigations, prescription
charges or fees from other doctors after referral
are deemed payable by the e-med member.
The doctors at e-med are happy to inform any other doctor you feel necessary about e-med consultations. We will need their address if you wish us to do this.
However if you do not want us to inform any other doctor about your e-med consultation then by law we can not do this. We will then take full responsibility for your care as pertains to the nature of the consultation.
Likewise you can simply print off your e-mail consultation and show this to your family doctor as you wish.
e-med reserves the right to refuse a person membership if their medical background is deemed unsuitable for online consultations.
Advice & Diagnosis:
Due to the nature of the phone and e-mail, advice
and diagnosis is given without the benefit of
physical examination. We rely on the information
you give your doctor at that time, and also the
information you give when you fill in the health
questionnaire.
e-med is not responsible if you withhold
information and you must provide the necessary
and relevant information when asked by your doctor,
if you do not e-med is not liable for
any consequences of the advice or diagnosis given.
As e-med has a physical presence your
doctor may ask for a face to face consultation
to help form a diagnosis or for some investigations
to be performed to aid diagnosis, we will give
you a time and date to come and see us physically
and it is your responsibility to arrive at that
point in time. Failure to attend without prior
notice will mean that the full fee will still
be payable, and debited from your credit card.
If you are remote from your e-med doctor
we will give you advice on how to access local
medical provision but will not be responsible
for arranging an appointment with another non
e-med doctor, nor are we responsible for
the actions of that doctor or other 3rd party
healthcare worker. If you have an emergency medical
problem then you must access your local emergency
medical services, and e-med is not responsible
should you not do this.
No promises are made or given or intended by
the advice given by e-med and no information,
advice or diagnosis made by e-med shall
be deemed the only or best possible at that time
with respect to the matter in question.
Prescriptions:
Prescriptions issued by e-med are considered
to be private and not NHS. e-med has no
jurisdiction as to the cost of the medication
which may vary from pharmacy to pharmacy, and
e-med is not responsible should the medication
be taken inappropriately.
e-med is not responsible if the member
takes undisclosed medication from another source
or has a medical condition that has not been
disclosed on the health questionnaire and there
follows an adverse reaction to the e-med
prescribed medication.
e-med will not prescribe certain medication
i.e.. morphine, diamorphine, methadone, amphetamines;
and reserves discretion in prescribing other
medication i.e. benzodiazepines, opiates.
e-med and its doctors reserve the right to refuse to generate prescriptions if we deem that it is not in the best interest of the patient.
If your e-med doctor deems it necessary
to have a face to face consultation before prescribing
then the member has to come in before a prescription
can be issued.
A further item charge will be made if the prescription
has to be reissued due to loss or theft, and
e-med reserves the right to not reissue
a prescription if e-med feels that'' loss
or theft'' is a means of obtaining further supplies
of the medication before the next due date.
If a member refuses to pay after arrangement
of a prescription then his membership will foreclose
with no refund. If a member has joined for the
sole purpose of obtaining Class 1 or 2 drugs
then membership will be revoked with no return
of joining fee.
If you are planning on taking any medication prescribed via this website to any foreign destination, please make sure you are aware of that country's rules and regulations at their customs.
We are happy to supply any paperwork necessary - but it is up to you to find out exactly what is needed before you travel.
We will need 2 weeks notice to supply this paperwork and no refunds will be issued if your medication is confiscated.
Investigations:
These can be arranged for members if details
of local private hospitals are given to e-med,
however the costs of the investigations will
fall on the member and e-med is not liable
for any accident, loss, or injury suffered during
the course of obtaining the investigation.
Membership:
Membership will be terminated without reimbursement
of fees if: the member behaves in such a way
that is deemed rude or aggressive to other e-med
members, the member behaves in such a way that
is deemed rude or aggressive to doctors or staff,
non payment of agreed fees any attempted abuse
of the system or allowing others to use the system
in the members name. Once a member you agree
not to use e-med:
- (i)
in a manner that is prohibited by any law
or regulation, or to facilitate the violation
of any law or regulation;
-
(ii) to invade the privacy of third parties;
-
(iii) to impersonate e-med personnel
or other parties or entities;
-
(iv) to transmit unlawful, fraudulent, offensive,
obscene, pornographic, defammatory, abusive,
threatening, or otherwise objectionable material,
or
-
(v) to encourage conduct that would give rise
to civil or criminal liability; not to violate,
or assist in violating, the security of e-med,
whether intentionally, negligently or otherwise;
not to attempt to utilise another User's Account,
User Name, Password, PIN and not to transmit
by means of e-med any data or material
that contains software viruses or any other
malicious code designed to interrupt, destroy
or limit the functionality of any computer
software or hardware or telecommunications
equipment.
Membership Renewal:
The term of this agreement shall be for a period of 1 year. The Agreement will be renewed automatically for 1 year periods. Either party may notify the other party of its intention not to renew by giving written notice.
PIN & Password:
When you have been accepted as a member, you
will be issued an identification code or PIN
and a Password ("Password") that will be required
to access e-med services. After the initial
issuance by e-med, you may change your
individual Password and inform us immediately.
You may access e-med services only using
your PIN and Password, and may not allow any
other person to access e-med using your
PIN and Password.
You agree:
-
(i) not to disclose your Password to any other
person or entity;
- (ii)
to make all reasonable efforts to keep your
Password secret and confidential; and
-
(iii) to promptly notify e-med of any
actual or suspected breach of security of
e-med, such as loss, theft or unauthorised
disclosure of your PIN or Password.
You are solely responsible for maintaining the
confidentiality of your Password, and personally
responsible for all use, whether authorised or
unauthorised, of e-med under your Password.
REMEMBER YOUR USER NAME AND PASSWORD! If you
forget either of them, e-med may disclose
them to you under security procedures determined
by e-med, which may result in delays in
your ability to access e-med services.
Identification:
e-med may request a form of identification from you when you join the service as an added security measure and to prevent fraudulent transactions.
This can be a scanned copy of ONE of the following documents:
- Current EU/EEA passport, photo driving licence or identity card
- Any other current signed passports (except USA)
- Current UK drivers licence
If you cannot provide the documentation above, please send us a scanned copy of TWO of the following documents:
- Bank or building society statement
- Utility bill (such as gas or landline phone bill) dated within the last six months
- Local authority tax bill for the current year
- Tenancy agreement issued by a solicitor, housing association, local council or reputable letting agency
- HMRC Tax Notification
- Biometric Residence Permit
- Blue disabled drivers pass
- Benefits or pensions notification letter confirming the right to benefit
In addition to the two documents provided above (for those that cannot provide photo ID), we require a photo of yourself to be signed by someone else (a 'countersignatory') to prove your identity.
Your countersignatory must have known you for at least 2 years, be able to identify you, eg they're a friend, neighbour or colleague (not just someone who knows them professionally), be 'a person of good standing in their community' or work in a recognised position (eg doctor, nurse, teacher, solicitor, etc). They can't be closely-related to or involved with the person applying, eg: related by birth or marriage or be in a relationship with or live at the same address as the person applying.
Your countersignatory must live in the UK and have a current British or Irish passport. If you're applying outside the UK, your countersignatory must have a current British, Irish or other EU, US or Commonwealth passport.
Your countersignatory must check your photo and attach it to a letter and sign it. The should also state on the letter:
- Their relationship to you
- That they've known you for more than 2 years
- That you're who you claim to be
- Their full name and passport number on the form
- The date the form was signed
If this is not supplied when requested, e-med may decline to carry out consultations and your membership will be refunded.
Consent to care and treatment:
By joining and consulting with e-med, you are consenting to care and treatment in line with current legislation and guidance including the Mental Capacity Act 2005. Patients will be deemed to have accepted the proposed treatment once they have accepted e-med's online terms and conditions. Consent can be provided via the Internet (e-med's website when ordering prescriptions, requesting referrals or seeking medical advice), written, verbal (either phone or skype) or implied. When a patient accesses e-med's website with a view to using the healthcare services provided, e-med will assume that a patient has capacity to do so. Where a patient refuses a proposed treatment, e-med will respect their decision.

b. We understand the importance of keeping any information that you give us secure and being transparent at all times about the way we use any such information.
c. This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us when you use our services. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
- INFORMATION THAT MAY BE COLLECTED ABOUT YOU WHEN YOU USE E-MED
We may collect and process the following data about you, some of which will include "personal data" and/or "sensitive personal data" as defined by the Data Protection Act 1998 as amended (the "Act"):
- information you provide us when you join e-med, including your name and contact details and the name and contact details of any Patient (if you are not the Patient), we may also ask you for details about the Patient?s usual GP (any such details, "Member Details");
- information you provide us when you request a consultation, including your name, your home address, the symptoms of the Patient and your financial details (any such details, "Consultation Details");
- E-med will not store your payment card details. E-med works with Secure Trading of the world?s leading payment card handling providers, which is PCI DSS compliant. When you make a Booking with E-med a secure payment token is provided to E-med. E-med is not able to access payment card information.
- information provided to a doctor during a consultation, including details of the Patient?s medical history and current medical condition (any such details, "Medical Details");
- details of the transactions you carry out on E-med, including the amount paid by you;
USES WE MAY MAKE OF YOUR INFORMATION
- to carry out our obligations (in accordance with our Terms) arising from your use of E-med. This may include contacting you by email and telephone on matters relating to your consultation;
- for the purposes of resolving any disputes which may arise in respect of the provision of E-med;
- to notify you about changes to E-med.
By accepting the terms of this privacy policy you are consenting to the various uses of your information described above by us. However, if you wish to withdraw your consent at any time, please notify us by emailing us at doctor@e-med.co.uk. Please note that if you do withdraw your consent we may be unable to provide some or all of our services to you, and you accept and acknowledge that we have no liability to you in any such event.
DISCLOSURE OF YOUR INFORMATION TO THIRD PARTIES
- If you book a consultation, we will disclose your consultation details to E-med doctors.
- E-med Doctors will only be authorised by us to use your Consultation Details for the following purposes:
- to provide you with a Consultation (which may include recording and saving attendance notes "Consultation Notes");
- for the purpose of resolving any dispute between you and them in relation to any Consultation; and
- as required by law and/or other relevant regulations.
- Details of the Consultation Note may be stored by E-med, and may be made available to any E-med Doctors allocated to your Consultation
We may disclose your personal information to third parties for the following purposes:
- to our employees and third parties ("data processors") who are contracted to provide services to us to assist us in the provision of E-med. Any employees and/or data processors contracted by us will be subject to strict contractual requirements only to use your personal data in accordance with this privacy policy;
- if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements or to protect the operation of our website, or the rights, property, or safety of us, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction;
WHERE WE STORE YOUR PERSONAL DATA
- We would advise you not to include sensitive personal information in any emails you may send to us.
- Please do not send credit card numbers or any sensitive personal information to us via email.
- The data that we collect from you (or which is stored on MIDEX) will not be transferred to or stored at a destination outside the European Economic Area (EEA).
- We will take precautions, including administrative, technical and physical measures to safeguard your personal information against loss, theft, misuse, as well as unauthorised access, disclosure, alteration or destruction. However, the transmission of information via the internet is not completely secure; any transmission is at your own risk.
- You can help us by also taking precautions to protect your personal data when you are on the internet.
YOUR RIGHTS
- You have the right to access information which we hold about you free of charge. Your right of access can be exercised in accordance with the Act, and you can contact us at our registered address as given above. We endeavor to answer your request within 30 days, as required by the current law.
- You also have the right to ensure that we hold correct and up to date information. If you believe that any information we hold about is incorrect or out of date, please contact us at our registered address. We may need to ask you for further information and identification to help us to comply with this request.

through hypertext links ("linked sites"), and
is not responsible for their content. The linked
sites are for your convenience only and you access
them at your own risk. In no event will e-med
be liable to any party or any general, special,
direct, indirect, incidental, consequential,
exemplary and punitive damages for any use of

Copies of Medical Notes:
e-med is happy to send your medical notes to a third party, e.g. another
doctor or lawyer. We will need written permission from you before doing so.
We can do this by email for free.
However for paper copies of your notes to be produced and forwarded, we will
need written permission from you, and there is a cost of up to US$40 per sheet
as our staff time is valuable. This is payable in advance to e-med.
Complaints:
Any complaint about e-med or medical advice
or diagnosis provided by e-med doctors
will be handled in writing or e-mail to e-med.
If the matter is not solved then a face to face
visit will be needed to resolve the problem.
e-med will not be responsible for any
fees for travel or lost time if they are incurred.
These terms and conditions shall be governed
by and construed in accordance with the laws
of England and Wales. Disputes arising shall
be exclusively subject to the jurisdiction of
the courts of England and Wales.

e-med contains copyrighted material, trademarks
and other proprietary information of (collectively
"Proprietary Material"), including, but not limited
to, text, software, photos, graphics and images.
You agree not to modify, publish, transmit, participate
in the transfer or sale, create derivative works
of, or in any way exploit, in whole or in part,
any Proprietary Material.
Except as otherwise expressly permitted under
copyright law, no posting, copying, downloading,
uploading, transmission, retransmission, distribution,
redistribution, publication, republication, recompilation,
disassembling, reverse engineering, or otherwise
modifying or commercially exploiting of any Proprietary
Material or material made available through e-med
will be permitted without the express permission
of the copyright owner. In the event of any copying,
